ATF and FDA Investigation Results in the Arrest of Barbourville Pharmacist
Arraigned on a 23-count Indictment for illegally selling weapons and drug samples LONDON, Ky., March 17 /PRNewswire-USNewswire/ -- Calvin Lynn Manis, 61, of Barbourville, Ky., was arrested today by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), after being summoned to appear in U.S. District Court, as a result of a 23-count federal indictment charging Manis with violating federal firearms laws announced ATF Special Agent in Charge Paul Vido of the Louisville Field Division, Acting U.S. Attorney James A. Zerhusen for the Eastern District of Kentucky, and Kim A. Rice, special agent in charge of the United States Food and Drug Administration (FDA), Office of Criminal Investigations.
The indictment alleges that Calvin Manis, the owner and operator of Parkway Pharmacy and a federal firearms licensee (FFL) of the same name, on or about February 2003 illegally sold and or traded prescription drug samples in violation of federal law. Moreover, the indictment alleges between 2003 and 2006, Manis, acting as a FFL, commonly known as a gun dealer, knowingly violated five federal firearms laws to include: selling pistols to people who he knew or reasonably should have known were convicted felons; making at least three separate multiple sales of pistols and revolvers to the same person on the same day without reporting this information to law enforcement as required by law, making more than 14 separate false statements on the Federal Firearms Transaction Records (ATF Form 4473), which resulted in a straw purchase where high power firearms were sold and transferred to individuals who could not legally possess these weapons. All of these alleged violations occurred in Knox County, Ky. A straw purchase is any purchase where the buyer is not eligible to own the purchased item according to the law and therefore purchases the item through a proxy buyer.
"Such joint investigations like this one are critical to stopping dangerous weapons from falling into the hands of those who can not legally possess them," Vido said. Vido went on to say, "ATF prides itself on working with our regulated firearms licensees to ensure their business follows the law. Unfortunately, there are always a few who attempt to circumvent the law for their own personal gain." The case is being prosecuted by Assistant United States Attorney Greg Ousley. The ATF London Satellite Office and the FDA Office of Criminal Investigations, Metro-Washington Field Office, are conducting this investigation as part of their combined missions to protect the public and reduce violent crime. The trial date for Manis has been scheduled for May 19, 2008, at 10:00 a.m., in the U.S. District Court located in London. If convicted, Manis faces a maximum prison sentence of 10 years.
